Red Fawn Fallis Plea Agreement

Walking up to the Federal Court house in Bismarck, ND a knot began to form in my stomach. Since the stand at Standing Rock, over 800 water protectors have been charged and 6 face felony charges in Federal Court. Red Fawn Fallis is one of those who have been unrightfully imprisoned and charged of 3 felonies over the last year. Because of the corruption and the looming possibility of facing life in prison for standing up for our water, Red Fawn Fallis decided to sign a plea agreement and plead guilty on 2 of her 3 counts. She was preparing to plead guilty to felony counts of civil disorder and possession of a firearm and ammunition by a convicted felon. Her plea agreement will dismiss her most serious charge, discharge of a firearm in relation to a felony crime of violence, and recommend no more than seven years at sentencing, as well as no fine or restitution.

Red Fawn entered the court in shackles and orange striped prison attire to a somber crowd of 20-30 familiar faces in the court room. Many supporters were turned away though there was more than enough seating. Red Fawn's attorney made a request to Judge Hovland that she be unshackled for the trial, the US Marshal agreed and she was unchained. She was shaking but stood strong as the judge asked the questions he was required to ask by law. He explained everything to her to make sure she understood the plea completely, his disposition was much more civil than the judge we had seen sentence Mary Redway. Tears began to well as the judge prepared to ask Red Fawn how she plead to the first count of civil disobedience. Red Fawn paused for a few moments- I thought for a second she was going to stand up and shout Mni Wiconi! However, with a shaky broken voice she sputtered out, "guilty." I looked around and saw tears running down the cheeks of some of the strongest women and men of the movement as they sat in support. The second felony count was read and again, "guilty" echoed through the chamber.

Judge Hovland explained what would happen next, an in depth interview would be done with Fallis in the next month or so and a report would be finalized. He said that he would take the letters of support into high regard. It is the best way, he said, to truly understand a defendants character and find out how they contribute to society as a whole. Red Fawn's lawyers then asked if they could submit a petition to release her from detention. She is being held at the Burleigh-Morton County Detention Center, and admitted to the pretrial release violation. Hovland said she was unaccounted for an entire day from the halfway house where she has resided since October. When asked if she wanted to explain herself, through tears she said,

“I don’t want to offer any excuses, but I hold the court in the highest regard. With the trial coming up I needed some time to sit and think. It’s hard being up here with no family or anyone to talk to. I apologize.”

Judge Hovland agreed that if this was even going to be considered she would have to have GPS tracking until the sentence date which will take place in 3-4 months. Defense attorney Bruce Ellison said Red Fawn's legal team will call a number of witnesses at sentencing and Assistant U.S. Attorney Gary Delorme said he may call on a few as well. Red Fawn's attorneys have advised a sentence of 21 to 27 months, while the federal prosecutors may recommend 46 to 57 months.

It was hard to sit and watch someone who stands for Mother Earth and our water have to face such extreme penalties from our "justice" system. It makes you wonder about the word justice and what that means for Natives versus the Bundy family. We will continue to stand with all the water protectors who put their life on the line for our Mother. Thank you Red Fawn for what you stand for and continue to stand for.

Heath Harmon, paid FBI informant at Standing Rock water protector camp, owned the revolver Red Fawn Fallis is charged with firing. Harmon, from Fort Berthold, North Dakota, posed as Red Fawn's lover, and continued to deceive her after she was jailed, sharing his notes with prosecutors.

A new article by C.S. Hagen, at High Plains Reader, reveals Harmon was not the only infiltrator. Further, TigerSwan mercenaries worked without a license in North Dakota, and in conjunction with local and joint law enforcement task forces. TigerSwan was involved in promoting dissension within the camps, and entrapping the water protectors who were targeted by law enforcement, according to court documents.
Hagen, in the article, NO DAPL activists hoodwinked by Paid FBI Informant, Defense says, writes that Harmon will receive.$40 a day as pay as an FBI informant, when Red Fawn goes on trial on Jan. 29, 2018, at the federal courthouse in Fargo, North Dakota.
Hagen reports, "Harmon, however, may not have been the only infiltrator; he’s simply the only person known by name, so far. Others were embedded in the camps, according to the testimony. Informants gave briefings to law enforcement about what they had witnessed."

Officer Chad Harmon was on the BIA Police Force at Standing Rock at the time, and continues to be.

The Intercept reports that Heath Harmon's uncle Gerald Fox was a BIA officer at the standoff at Wounded Knee and then at all major Native struggles, in a BIA special operations unit. 

During those years, Red Fawn's mother, Troy Lynn Yellow Wood, was among the members of the American Indian Movement targeted by law enforcement. Before her death, Denver Intelligence Police files exposed in court showed the targeting of the American Indian Movement.
Earlier, COINTELPRO was exposed, showing the widespread targeting of AIM, the Black Panthers and others.

The Intercept reports: 



Harmon is part of a different lineage. In his interview with law enforcement, he noted that his uncle Gerald Fox had been on the “other side” of the AIM struggle at Pine Ridge. Fox was a BIA officer who stood off against AIM during the 71-day occupation of Wounded Knee, alongside members of the U.S. Marshals Service and the FBI. According to a 2010 obituary in the Bismarck Tribune, Fox went on to join a BIA special operations unit, and between 1976 and 1984 “was detailed to every major Native conflict that happened in the United States.”

The Reality of Oil and Gas Industry: Crime and Destruction

The resistance to Dakota Access Pipeline at Standing Rock is a continuation of the struggle against the oil and gas industry in North Dakota, which is driven by politicians, and fueled by the co-opted media and the police, for the benefit of private corporations.

Three Affiliated Tribes, where Heath Harmon is from, has been a nucleus of violent crime due to the oil and gas industry.
Former Chairman Tex Hall gained popularity at the National Congress of American Indians, before Hall inundated the land with oil and gas drilling, poisoning the land, water and air, and man camps brought in violent crime.
Then, Hall's oil and gas business partner was convicted of the murder-for-hire of two of their business partners, including a young man who was bludgeoned to death.
The man camps of oil and gas workers have brought violent crimes, sex crimes and the exploitation of women and children.

Madonna Thunder Hawk, Lakota, is live in Palestine, speaking out on Indigenous rights. Madonna’s words and support come just after Israel blacklisted 20 activists groups and banned them from entering Israel.
Madonna, who was at the occupations of Alcatraz and Wounded Knee, describes the most recent resistance at Standing Rock, to the Dakota Access Pipeline, and the history of genocide and global oppression for Indigenous Peoples.
“We don’t need to be told constantly who we are. We know who we are,”
Meanwhile, in Chiapas, Zapatista women are organizing the Women in Struggle gathering for March of 2018. Zapatista women will create art and poetry. They say men won’t get past the kitchen, where they will cook and do cleaning.
In other censored news, water protectors in North Dakota, were convicted of felonies in an action to bring attention to missing and murdered Indigenous women, and the crime-infested man camps of the fossil fuel industry on Native American lands.
“When they’re raping our mother earth, they are also raping our women,” water protectors said.
Water Protector Legal Collective said, “The second group of trials from the Standing Rock action in commemoration of missing and murdered indigenous women concluded today. The Intercept has exposed that an FBI infiltrator, Heath Harmon of Fort Berthold, North Dakota, owned the revolver that Red Fawn Fallis is charged with firing at Standing Rock during the resistance in 2016. Harmon posed as Red Fawn’s lover and continued to deceive Red Fawn while she was jailed, sending his notes to prosecutors. Red Fawn is scheduled for trial in Fargo, North Dakota, in January of 2018.
Standing Rock water protectors were also deceived and betrayed by a self-appointed mediator at the Nobel Peace Prize Forum in Norway in December, when a Morton County Commissioner was brought to the forum by the mediator. Water protectors said the mediator acted without any authority, both at the Nobel Forum, and in camp in 2016.
Chief Arvol Looking Horse responded to the mediator's unauthorized actions which endangered those present in Norway:
Morton County used the Nobel Peace Prize Forum to meet with the mining industry in Norway and attempted to discredit the media coverage of the resistance at Standing Rock, according to its press statement.
Morton County was responsible for bringing in the violent militarized police to Standing Rock in 2016, and the assaults with tear gas, rubber bullets and water cannons on unarmed water protectors. Further, Native American women and elderly were among those arrested and jailed in dog kennels with numbers written on their arms as was done by the Nazis.
With the collapse of the last remnants of the failing mainstream media, independent media is  needed more than ever. Please support grassroots efforts on the frontline, and in the homelands.

FBI Informant's Misconduct Continued after Red Fawn was Jailed

Update 2021: Red Fawn served her prison  sentence and was released. Read how paid FBI informant Heath Harmon pursued a romantic relationship with her at Standing Rock Camp in 2016. As police swarmed and arrested Water Protectors, Harmon insisted she wear his coat that secretly had his revolver in it. Harmon was paid $2,000 as an FBI informant.

The misconduct of paid FBI informant Heath Harmon, 46, of Fort Berthold, North Dakota, has been exposed by The Intercept.

Harmon was a paid FBI informant in Standing Rock water protector camps, giving the FBI regular reports from August to October, while in camp, court documents show.
It has just been exposed that Harmon owned the revolver that Red Fawn Fallis is charged with firing during her arrest.
Harmon engaged in an intimate relationship with Red Fawn, while concealing the fact that he was an undercover FBI agent in Rosebud Camp at Standing Rock.
Even after Red Fawn was in jail, Harmon continued to call her, and withheld the fact that he was an FBI informant. The information from those phone calls was shared with local and federal police officers and prosecutors.
Red Fawn's supporters are now calling for an investigation into the ethics of an FBI informant engaging in a sexual relationship with a target while concealing his identity. Similar cases have successfully been filed in court against undercover officers in England.
In England, after an undercover officer had relationships with women, the women sued. Among the charges they filed were assault, negligence, deceit and misconduct by senior officers.
Harmon's intelligence gathering and deceit did not stop when Red Fawn was arrested on Oct. 27, 2016. Harmon continued his work as an undercover government spy.
The Intercept reports:
Harmon spent the day of October 27 with Fallis and was nearby during her arrest. He continued to withhold his FBI affiliation from his then-girlfriend in phone conversations with her while she was being held at the Morton County jail in Mandan, North Dakota, records show. Investigators’ notes on those calls were distributed to the ATF, two local sheriff’s departments, and the U.S. Attorney’s Office in Bismarck, among others.


In Florida, prosecutors dropped and reduced charges against defendants, after finding out undercover detective had sex with targets, which violates Florida law, according to case law.

"Having sex with the suspects in the cases constitutes entrapment and violates the defendants’ due process rights, according to Florida case law cited by defense lawyers. Also, any sexual relationship between an informant and a target violates the rules of nearly every law enforcement agency, federal, state or local."

The targeting of Red Fawn by the FBI comes as no surprise.
 Red Fawn's mother Troy Lynn Yellow Wood was active in the American Indian Movement and was among those targeted, before she passed to the Spirit World.
Documents from the Denver Police Intelligence Department exposed a massive spy operation targeting the American Indian Movement in the 1990s. It stretched from Denver  throughout the country, with police and federal agents tracking anyone affiliated with AIM, even those who simply had a Free Peltier bumper sticker on their car.
The Intercept reports:
Federal prosecutors are charging Fallis with civil disorder, possession of a firearm by a convicted felon, and discharge of a firearm in relation to a felony crime of violence — perhaps the most serious charges levied against any water protector. If convicted of discharging the weapon, she faces a minimum of 10 years in prison and the possibility of a life sentence. She has pleaded not guilty.

It is no surprise that Red Fawn was targeted by the FBI. Her mother was also targeted before she passed to the Spirit World, along with all those affiliated with AIM in Denver. The facts were exposed in the 1990s that Denver Police Intelligence Dept. tracked and spied on everyone associated with AIM, even a grandmother who simply had a Leonard Peltier bumper sticker on her car. This spy operation spanned the entire country and was exposed during a court case in Colorado, when boxes of spy files became public. It was only one of these that tracked and targeted. There was also COINTELPRO and the international spy operation Operation Chaos, targeting AIM and other movements and their supporters in other countries. Denver Police agreed to change their policies after the exposure, but of course the spying and targeting continued by the joint task forces. My articles on this are on the web. -- Brenda Norrell
