Actions are taking place across Canada and internationally on Tuesday November 27 in support of the Unis’tot’en, who grabbed national headlines when they evicted shale gas pipeline surveyors from their territories in the interior of BC last week. The Unis’tot’en have made it clear that no proposed pipelines will proceed in Unist’ot’en territories and that corporations, investors, and governments have no jurisdiction to approve development on their lands.

On November 20, Wet’suwet’en Hereditary Chief Toghestiy intercepted and issued an eagle feather to surveyors from the Can-Am Geomatics company, working for Apache’s proposed shale gas Pacific Trails Pipeline. In Wet’suwet’en law, an eagle feather is used as a first and only notice of trespass. The surveyors were ordered to leave the territory and the road entering into the territory has been closed to all industry activities until further notice.

GILA RIVER INDIAN COMMUNITY, Ariz. -- Since 1983, the Arizona Department of Transportation (ADOT) has threatened the health, environmental quality and culture of the Gila River Indian Community (GRIC) by attempting to build the Loop 202 South Mountain freeway extension on or near tribal land.
For over 12 years, GRIC has continuously voiced its opposition to the Loop 202 extension. In February 2012, the community reaffirmed its opposition by voting 720 to 603 for the No Build option in a single-issue vote on the 202.
Still, ADOT and pro-freeway supporters like Pangea, a land development corporation, continue with their plans centered on the construction of the freeway extension on tribal land. Any proposed freeway routes, on or near GRIC lands, would destroy Muhadag Do’ag (South Mountain), threaten public health and air quality in Gila River, allow biohazardous and nuclear waste onto Community lands, destroy desert habitats of plants and animals, and allow the urban sprawl of Phoenix to invade GRIC.
 
Musicians come together to Stop the South Mountain Loop 202 Freeway
What: Benefit show to raise awareness of the threat of the proposed South Mountain Loop 202 freeway extension on or near the Gila River Indian Community.
Who: Indigenous musicians from the Gila River Indian Community, the Tohono O’odham Nation, Navajo Nation and Phoenix area will be performing at the Santan ballfields from 5:30pm to midnight. This is an alcohol-free event. Bands performing at the benefit show are:

First Nation and Metis denied justice fighting Shell's Jackpine Mine

First Nation and Metis groups denied effective access to justice

Fort McMurray, Alberta – Today the Athabasca Chipewyan First Nation (ACFN) received a decision from the Alberta Court of appeal dismissing their application for leave to appeal a decision of the Joint Review Panel to not review the adequacy of Crown consultation before deciding whether to approve Shell’s Jackpine Mine expansion project. The First Nation is extremely disappointed and is currently reviewing their options to address the lack of adequate consultation with respect to Shell’s tar sands project.

“Our rights are being overlooked and that is a truth that cannot be denied,” stated Chief Allan Adam of the ACFN. “If there is a violation of our constitutionally protected treaty rights it should be dealt with before this project is found to be in the public interest. A project of this magnitude couldn’t possibly be in the public interest if our rights have not been upheld and we have not been adequately consulted.”

During the course of the last month the ACFN have been raising multiple concerns within the Joint Review Panel hearings on Shell’s Jackpine Mine expansion citing poor consultation and direct and adverse effects on the First Nations’ ability to continue its treaty and associated aboriginal rights to hunt, fish, trap and gather. The decision today stressed that the hearings were a part of the consultation process yet the Alberta government has been absent and even referred to themselves as “strangers” to the process.

“Who has better jurisdiction to deal with our rights and the adequacy of consultation more appropriately then the bodies that grant approval? Our rights are shuffled from agency to agency with no real remedy,” stated Chief Adam. “There has been a complete devolution of the Crown’s duty to consult pushing consultation into the hands of the proponents and downgrading First Nation rights. Our people are being failed by all levels of government.”

ACFN’s challenge to Shell’s application has come on the heels of a legal suit against the oil giant for failure to meet past agreements to mitigate impacts of their current projects. Remediation and mitigation are supposed to be dealt with through Impact Benefit Agreements made with the proponents themselves, although such agreement do not have any Crown oversight or involvement. As Shell has not lived up to past agreements, ACFN was asking the Joint Review Panel to assess Crown consultation before project approval.

The ACFN hopes this ruling will at the very least push the Crown to reassess its role and obligations with respect to the duty to consult, a role they have been absent from, and a role that the Alberta Court of Appeal says the Crown has committed to undertake.

On October 6 & 7th of 2012, many Dineh grandparents and parents gathered with their kids to celebrate the Sovereign Dineh Nation (SDN) Big Mountain Survival Camp Summer School, which was held for its last year in 1992. Long time supporter for the Big Mountain traditional elder resisters, Martha Bourke with much support and contribution, organized this commemoration gathering. More than 40 children and at least 25 young teens came to participate in activities that were very similar to the two week summer programs of 1991 and 1992. Here is a 7 minute slide show of this two day event, an event that was dedicated and an honour to the Elders and the little ones. Many others like members of BMIS and local coordinators help facilitate this rare, Indigenous-community sponsored School that was without State control.

We, SDN and network supporters, hope to have the 2013 SDN-BM Survival School again and we like to see it for more than just two days but rather have it for two weeks. And so remember us and support us Re-occuppy the Ancestral Lands, It's THEIR Future! These ancestral homelands must not continued to be occupied by Peabody Coal Company for its black-gold mine.
