Apache Stronghold Solidarity with Standing Rock Against Pipeline

.

Apache Stronghold brings power of Geronimo to Standing Rock

Wendsler Nosie Sr, San Carlos Apache Councilman, and leader at Apache Stronghold, traveled to North Dakota to offer support and prayers to Standing Rock Sioux Tribe. "Wendsler and Standing Rock Chairman David Archambault II met Saturday as two leaders and two men who understand what it means to fight for their people, their waters and their land. The Apache Stronghold have been fighting to protect their sacred site Oak Flat in Arizona for 10 years with going on two years occupation from the foreign mining company, Rio Tinto." Apache Stronghold Stands in Solidarity with the Standing Rock Sioux Against the Pipeline

By Allie Fredericks

CANNON BALL, North Dakota -- Apache Territory has been taken away piece by piece from the beginning of the Reservation system. It began with the loss of the Chiricahua Reservation, the loss of the Aravaipa lands, then after the San Carlos Reservation was established, the loss of Mt. Graham for its timber, the loss of the eastern side for Copper, Silver and Water and then the loss of the western side for Copper, and Silver again. Just like the Apache, Sioux lands have been taken away for decades, beginning with a 1851 treaty that was not honored than another treaty in 1868, then gold was found in the Black Hills, then the 1941, 1954, and again in 1960 the reservation was reduced for Dams and flooding. Now they are threatened by an oil pipeline that is less than one mile away from their northern border that threatens their water source which is upstream.
The Sioux are fighting to keep the oil pipeline out of the watershed of sacred tribal lands, lands that are ancestral homelands. Likewise the San Carlos Apache Tribe and Apache Stronghold are trying to keep a sacred site, Oak Flat, from being destroyed by Resolution Copper and protecting the water that will be taken to mine the copper that will deplete the San Carlos water aquifers.
Wendsler Nosie Sr. and Apache Stronghold stand in Solidarity with the Standing Rock Sioux to protect what is left. Wendsler Nosie Sr. wrote in a letter from the Stronghold to the Standing Rock Sioux Chairman Archambault II, “As indigenous people, the recent stand against the Dakota Access Pipeline, and the inevitable loss of water and sacred places affects all people. Your issues are our issues."

Good people are gathering in Cannon Ball, ND to stop the Blue man, who has come in the form of a poisonous pipeline. Pipelines running under shifting river beds where they cannot be observed, are ticking bombs for the environment and clean water.‪#‎DakotaAccessPipeline‬ ‪#‎NoDapl‬
From Black Elks Vision "I could see the hills and valleys and the creeks and rivers passing under. We came above a place where three streams made a big one--a source of mighty waters--and something terrible was there. Flames were rising from the waters and in the flames a blue man lived. The dust was floating all about him in the air, the grass was short and withered, the trees were wilting, two-legged and four-legged beings lay there thin and panting, and wings too weak to fly.
Then the black horse riders shouted "Hoka hey!" and charged down upon the blue man, but were driven back. And the white troop shouted, charging, and was beaten; then the red troop and the yellow.
And when each had failed. they all cried together: "Eagle Wing Stretches, hurry!" And all the world was filled with voices of all kinds that cheered me, so I charged. I had the cup of water in one hand and in the other was the bow that turned into a spear as the bay and I swooped down, and the spear's head was sharp lightning. It stabbed the blue man's heart, and as it struck I could hear the thunder rolling and many voices that cried "Un-hee!," meaning I had killed. The flames died. The trees and grasses were not withered any more and murmured happily together, and every living being cried in gladness with whatever voice it had. Then the four troops of horse men charged down and struck the dead body of the blue man, counting coup; and suddenly it was only a harmless turtle."

SCUTTLE SCULLIN

MNN. 22, 2016. The motion was filed to remove US District Judge Frederick J. Scullin Jr. from sitting in this trial – Jones v. Parmley, et al.[5:98-CV0734 [FJS][GHL]. This case does not belong in any Admiralty court [all US courts]. It belongs in a non-Admiralty dispute resolution court, Permanent Court of Arbitration.
Trial starts on September 20, 2016.
Getting ready for the trial of “I-81 INDIAN Detail” starting on September 20, 2016, in Syracuse.

On August 18 Scullin arrived 10 minutes late to the “pre-trial meeting” and said, in effect, “This is my court and everyone shall obey my rules!” Five pro se plaintiffs/victims of the May 18, 1997 assault by the I-81 INDIAN Detail were a few minutes late. Security was holding them. Scullin immediately threw them out of the case. After verbal objections, they were reinstated.
Scullin: "Sooo .. I was trying to remember my lines".
Scullin J.: “Sooo .. I was studying my lines”.
Scullin appeared to be hostile, racist, biased, disrespectful and definitely not neutral. We cannot get a fair trial if he sits on the bench. The transcript and audio will support this.
Scullin asked if we still wanted a jury trial or a bench trial. Asst. Attorney General Tim Mulvey, lawyer for the “I-81 INDIAN Detail”, quickly jumped up and said, “Yes, yes, yes”. We said, “No, no, no!” We want a fair and impartial evidentiary hearing in an open court so a jury can judge the facts, with witnesses and evidence presented.
Every member of the I-81 INDIAN Detail must be tried. Their allegation they were “following orders’ was thrown out twice. Three police disks are filed, along with discovery, transcripts, interrogatories, police notes of the I-81 INDIAN Detail and a list of witnesses.
We want our day in court . Why did it take 18 years to get this trial?
Judge Scullin showed absolute disrespect. When pro se plaintiffs asked how to file and try to carry out court procedures, he said “That’s your problem”. th
We have been personally harmed by the attack on May 18, 1997 and by the subsequent procedural court machinations. We are not lawyers and have no experience in corporate law. Scullin deliberately tried to demean and demoralize us so that we will give up in frustration or he can throw it out. Then the INDIAN Detail criminals can remain unpunished and “at large”.
Scullin’s bias could help have this case thrown out through judicial procedural chicanery. He set unreasonable timelines, he told a 77-year old plaintiff to drive 5 hours and personally deliver documents to him which violates corporate Admiralty procedures.
We demand a hearing on this motion to remove Judge Scullin from our case before he rules on anything to do with our case.
Troopers James Parmley & George Beach getting their orders from the top.
Troopers James Parmley & George Beach getting their orders from the top. Gov. Cuomo promoted Beach to NYS Police Superintendent.
We have been left stranded by the court, our lawyers Hoffman, Anello, Peiken and the others.
Dinah Washington sings about big changes coming: “I’m gonna change my way of livin’, and that ain’t no shock. Why, I’m thinking of changin’ the way I gotta set my clock. Because nobody wants you when you’re old and gray. There’s gonna be some changes made today. There’ll be some changes made.”
Video: Scullin reminds us of the infamous Judge Roy Bean who said, “If they wanted a fair trial, they shouldn’t have come to my court”. Watch “The Life and times of Judge Roy Bean” http://putlocker.is/watch-the-life-and-times-of-judge-roy-bean-online-free-putlocker.html
