BREAKING: Federal court halts destruction of Oak Flat

Judge blocks feds’ rush to transfer Indigenous sacred site to foreign mining giant for destruction

A federal court just temporarily blocked the federal government from giving an Indigenous sacred site, Oak Flat, to a Chinese-owned mining giant for destruction. The ruling comes as the U.S. Supreme Court is considering whether to hear an Apache group’s appeal to protect the site.

By Becket Law, Censored News, May 9, 2025

WASHINGTON – A federal court today blocked the U.S. government from plowing ahead with plans to hand over the Western Apaches’ most sacred site at Oak Flat to a multinational mining giant for destruction.

In Apache Stronghold v. United States, the federal government recently announced that as early as June 16, 2025, it would transfer Oak Flat to Resolution Copper, a Chinese-owned mining company that plans to turn the site into a massive mining crater, ending Apache religious practices forever.

Democracy Now reports on Pegasus spyware in cell phones. It is a reminder of how our friend Klee Benally, Dine', was spied on by the Tohono O'odham Nation government as he protested the US Border Patrol, and the Salt River Project, and its role in poisoning Dine' with its coal-fired power plant.

The Tohono O'odham Nation government was the first tribal government to become part of a secretive inter-agency tribal/state/federal law enforcement Fusion Center that shared data.

PHOENIX -- Transporter of Stolen Migrant Children was 'Black Contract' Operator in Iraq and Afghanistan

Security contractor manned 'black site' prisons in Iraq and Afghanistan, protecting the torturers, and now has U.S. contracts to transport migrant children

PHOENIX -- The security contractor MVM was caught on video stashing children stolen from their migrant parents in a midtown Phoenix office building in June. MVM was a secret "black contract" operator in Iraq and Afghanistan, according to the Wall Street Journal.
MVM's secret contracts protecting the CIA and NSA, and manning secret black site prisons, became public in 2004 when MVM was sued in Colorado for sloppy work by an employee.
Today, MVM holds U.S. government contracts for the transport of migrant children.
MVM was caught on video in June stashing migrant children, as young as toddlers, at 2030 E. Osborn St. in Phoenix. MVM had just leased the office building and it was not licensed to hold children for days and weeks.
A neighbor's cellphone captured the video of the children being taken from white vans to inside the building, where neighbors said dozens of children were held up to 3 weeks.
A Phoenix police report reveals that one of the children, a 17-year-old boy, escaped and ran away.
Meanwhile, an ad in San Antonio reveals MVM is also hiring the staff at Southwest Key, where migrant children stolen from their parents at the borders are jailed, according to the directives of the Trump administration.
Southwest Key is now incarcerating migrant children throughout the Southwest.
After Trump began his "zero tolerance" plan, migrant children were photographed being held in cages in detention facilities. Lawsuits now expose extensive sexual and physical abuse of migrant children, and extensive neglect of babies, stolen by the U.S. government from their parents at the borders.
MVM currently has an $8 million U.S. contract to transport migrant children, and another $162 million U.S. contract to transport unaccompanied minors.

Exploiters of Gold King Mine Spill: McCain and University of Arizona

While McCain showboats with the Gold King Mine spill, and the University of Arizona profiteers from misery, Arizona and national media go brain dead, awarded Hypocrite Media Award

Arizona Senator John McCain is exploiting the Gold King Mine spill and the media is lapping it up like mindless robots.

It comes as no surprise that researchers at the University of Arizona in Tucson will be making big money, $600,000 to study the spill.

This is what the University of Arizona, and McCain, do best: They profiteer from misery.

While McCain is gearing up to turn Apaches sacred Oak Flat into a massive copper mine in Arizona, McCain weeps to the press about the gold mine spill, pretending to morn the loss of water and crops for Navajo farmers.

The media collects McCain's tears, publishing his false words with solace. After all, McCain would not still be on the US Senate Committee for Indian Affairs if the media was not bolstering him, with corporate criminals paving the way.

During a Congressional field hearing with the US EPA in Phoenix, McCain said he wants the Justice Department to investigate the Gold King Mine spill. But who will investigate McCain?

Arizona's media has become wimps.

Meanwhile, researchers at the University of Arizona will be making big money to study the spill.

Imagine what Navajo grassroots farmers could do with $600,000. Many Navajo farmers in the Shiprock, N.M., area lost their corn, bean and squash because they had no water to irrigate with after the EPA's reckless toxic spill.

Exploitation of Indigenous for dollars is what the University of Arizona does best.

Calling for a boycott of the university, Ofelia Rivas, O'odham has boycotted the University of Arizona for years, due to the role the university plays in the militarization of the border, creation of drones, and the targeting of Indigenous Peoples with the development of security and spyware.

Wendsler Nosie, Apache, also boycotts the university, following his arrest by university police while Nosie was praying on sacred Mount Graham. The University of the Arizona and the Pope took the lead in desecrating sacred Mount Graham with massive telescopes. The University of Arizona, the Pope, and the universities they partnered with, ignored and attempted to silence Apaches during the long years of court, and personal struggles, spent battling the construction of the massive telescopes on sacred Mount Graham.

Which brings us back to the desecration of Apaches sacred land.

While McCain and Arizona Rep. Ann Kirkpatrick showboat for their adoring media, they continue plans for a massive copper mine on Apaches' sacred Oak Flat. McCain sneaked the land exchange into the the US Defense spending bill.

The fact that McCain is still on the US Senate Committee for Indian Affairs is a clear indication of the collapsed US government system. It indicates that the media is in the bowels of this system.

The Arizona and national media -- including the stay-at-home reporters of Indian Country Today, -- are awarded the Hypocrite Media Award for flopped coverage.

As for the US EPA, the fact that the US EPA rubber stamps the environmental impact statements throughout Indian country, the border, and wherever poor people live -- devastating water, land and air -- is proof enough that the US EPA should not be trusted or believed.

And neither should McCain.

In August 2015, an estimated 3 million gallons of acid water and heavy metals spilled from the Gold King Mine into Colorado's Animas River, eventually flowing into the San Juan River, the primary source of irrigation for Navajo Nation farmers. The spill was caused by the U.S. Environmental Protection Agency. The EPA claims it was done while trying to prevent leakage of toxic materials.

Arizona ignored threat of border militia exposed by Anonymous

Arizona ignored threat of border militia exposed by Anonymous

By Brenda Norrell
Censored News

TUCSON -- Anonymous' Lulzsec hacktivists exposed Arizona police files last summer, revealing white supremacists and border militia were widespread, dangerous and heavily armed in southern Arizona.

Those hacked files revealed that armed white supremacists and border militia were largely ignored by Arizona police. Further, the Arizona media, out of fear, did not report the facts from those hacked police files or expose the danger. In fact, the Arizona media, refused.

On Wednesday, JT Ready, leader of the US Border Guard who appeared in photos and videos heavily armed on Arizona border patrols, apparently killed four people, including his girlfriend, her daughter and a 15-month old baby, in a murder-suicide that left five people dead in Gilbert, in the Phoenix Valley.

At the root of white supremacy in Arizona is the Arizona government, responsible for laws targeting people of color and the recent banning of Mexican American Studies in Tucson public schools and dozens of books by award-winning Chicano and Native American authors.

JT Ready had his friends and influences in the Arizona government.

When Anonymous’ Lulzsec exposed the Chinga La Migra files in the summer of 2011, Censored News published an article, with a video showing JT Ready, heavily armed, and on patrol in Arizona.

The article is: “Hacked data reveals US Marines as contract killers, hunting migrants on the border.” http://bsnorrell.blogspot.com/2011/06/hacked-data-reveals-us-marines-contract.html

Censored News also published another report from those hacked files in July, showing the danger to Arizona border residents. Border residents of the Sasabe area, bordering the Tohono O'odham Nation, were never informed of these dangers.

“In the leaked files of Chinga La Migra, a police report describes an encounter with a heavily-armed man at Sasabe and states there is a ‘mercenary-type; action planned for this area.

“In this second e-mail from police files, agents working in the town of Sasabe in March said they were approached by a man who engaged in a conversation with agents.” The agents said the man had a Glock pistol Saiga shotgun, 10 round magazine and a 20 round drum magazine.

“He stated that he is soon to receive funding in the amount of $350,000.00 from what he described as ‘Concerned citizens’ and that he planned to use this funding to bring up to five men into the area," the police report states.
http://bsnorrell.blogspot.com/2011/07/hacked-police-data-assassins-plan.html

Later, in October, when JT Ready showed up heavily armed at the start of Occupy Phoenix, Native Americans and anarchists responded with alarm at the presence of Ready and heavily armed members of the National Socialist Movement.

The Phoenix Class War Council said, "This attitude towards the NSM scum played out, quite predictably, along racial lines, with whites being the only ones to express attitudes of tolerance towards them. This points to the continuing importance of addressing racism and the continual appeal and relevance of racial privileges within the movement. Indeed, we can expand this argument to the whole attitude of the bulk of the white movement towards the police. Experiencing policing in quite different ways than people of color in general, white middle class liberals mistake their own experience for that of others, and routinely attack anyone who questions the alleged 99 percent status of the police, or points out their quite obvious tendencies towards violent action, as violent themselves. To question the violence of the police is to be violent, according to this backwards analysis."
http://bsnorrell.blogspot.com/2011/10/neo-nazis-show-up-armed-to-counter.html

As for those Arizona police files exposed by Anonymous’ Lulzsec, there remains many files revealing the extent of white supremacy and racism in Arizona, and the failure of Arizona police and the US Border Patrol to protect and save lives.

In one of those files, Arizona police point out that a ranch where police go to practice roping near Nogales is also a route of the Mexican drug cartel. The e-mail expresses interest only in the safety of the officers, and no concern for the safety of the people of southern Arizona. The cartel told officers to “look the other way” when they are off duty.

In another e-mail, Arizona police point out that the US Border Patrol based in Why, Arizona, near Lukeville, are leaving migrants to die in the desert south of Phoenix.

The extent of the white supremacy movement in Arizona is also revealed in those files, and the extent to which Arizona police ignore them.

Also exposed in those Arizona police files were the ATF Project Gunrunner's Weapons of Choice, with photos, from 2008. Project Gunrunner began in Laredo, Texas, in 2004, a fact that most media ignore.

The only high point in those police files exposed by Lulzsec is the information on a vote by a Phoenix area chapter of the Fraternal Order of Police. It is a vote of no support for racist and anti-immigrant Maricopa County Sheriff Joe Arpaio.

The Chinga La Migra files, I, II and III remain online.

UPDATE May 7, 2012: --Arizona border militia JT Ready shot the 15-month old baby in the head during the murder-suicide. Also, according to this article, weapons seized at the scene will be part of investigations into domestic terrorism. http://www.azcentral.com/arizonarepublic/news/articles/2012/05/04/20120504court-document-sheds-more-light-into-shooting.html
The same area where JT Ready led heavily armed 'border patrols' in southern Arizona is the same area where migrants were found murdered. These areas include the Eloy, Arizona, region, where vehicles were attacked and migrants murdered, and also along the Arizona border.
This report by Derechos Humanos shows some of the murdered migrants whose bodies were found, and the locations in Arizona: http://derechoshumanosaz.net/projects/arizona-recovered-bodies-project/

Hackers slam Arizona police for third time

Hackers slam Arizona police for a third time, exposing racist e-mails and secrets of Fraternal Order of Police

By Brenda Norrell

Image of online hackers Anonymous
Hackers slammed the Arizona Department of Police for a third time on Thursday night, exposing police e-mails with more racism directed at Arabs, anti-immigrant chain e-mails, and crude jokes about President Obama.

The Chinga La Migra Comminque III, "Fraternal Ownage of Police," targets Arizona's Fraternal Order of Police. The Antisec movement said they are defacing and taking down their websites, on behalf of the rights of immigrants and working people.

"You will no longer be able to operate your campaign of terror against immigrants and working people in secrecy: we will find you, expose you, and knock you off the internet."

At 2 a.m. on Friday morning, all city and state websites for the Fraternal Order of Police in Arizona were offline, including websites for Arizona, FPO Labor Council, Mesa, Tucson and Maricopa. On Friday morning, July 1, the websites were still down.

A message that appeared on Twitter said, "A wild deface appears: http://www.mesafop.com/. Hello, Arizona Police. 6500 officers trying to catch us, we read your mails."

On Friday morning on Twitter, the hackers said they are still reading the police e-mails. "One of the great parts of all this is that officials are writing the word 'LULZ' in their super-serious emails."

The statement with the third data release says, "In this batch of emails we found more racist email chain emails, including Springerville's police chief Mike Nuttal forwarding jokes about torturing 'ragheads.' FOP president Brandon L Musgrave was also forwarding anti-muslim emails while also purchasing large amounts of guns, so we're dumping his paypal and credit card information as well."

The e-mails reveal some of the secrets harbored by the Tucson Fraternal Order of Police.

Tucson Police Sgt. Musgrave's e-mails have purchases for AK parts, with anti-immigrant chain letters, and an incoming e-mail questioning the selection of 'Taz' as a potential Tucson police chief in 2009. It questions the choice and wonders how the candidate got "passed the stalking issue."

The incoming e-mail from a fellow officer in the Fraternal Order of Police says of 'Taz,' "Not to mention he is a stalker and nothing was ever done about that and I think he will have the same type of admin. (cover ups especially commanders) and don't forget he was one of those who resigned FOP because of what we did with Schlitz."

The e-mail forwarded by Springerville Police Chief Mike Nuttal praises torture. Springerville is located near both Navajo and Apache Indian Nations in northeastern Arizona, where Native Americans are targets in bordertown racist assaults.

The e-mail that Nuttal forwards says, "You've got to love this Guy!! DON CHERRY of hockey night in Canada , was asked on a local live radio talk show, just what he thought about the allegations of torture of suspected terrorists. His reply prompted his ejection from the studio, but to thunderous applause from the audience. HIS STATEMENT: 'If hooking up one raghead terrorist prisoner's testicles to a car battery to get the truth out of the lying little camel shagger will save just one Canadian life, then I have only three things to say: 'Red is positive, black is negative, and make sure his nuts are wet.'"

With three data dumps now by Antisec hackers Anonymous and Lulzsec, as Stephen Lemons at Phoenix New Times points out, there are still no e-mail releases of the racist and anti-immigrant Maricopa County Sheriff Joe Arpaio.

In the third release of e-mails, there is a lengthy statement from Arizona State Senator Sylvia Allen, in an e-mail of the Fraternal Order of Police in Tucson, on borders and immigration.

Sen. Allen said of immigrants, "It will do no good to give them amnesty because thousands will come behind them and we will be over run to the point that there will no longer be the United States of America but a North American Union of open borders.

"I ask you what form of government will we live under? How long will it be before we will be just like Mexico , Canada or any of the other Central American or South American country? We have already lost our language, everything must be printed in Spanish. We have already lost our history, it is no longer taught in our schools, and we have lost our borders."

"The leftist media has distorted what SB 1070 will do. It is not going to set up a Nazi Germany. Are you kidding? The ACLU and the leftist courts will do everything to protect those who are here illegally ...," Sen. Allen said in the statement sent by e-mail on June 6, 2010.

Here is the Antisec statement for the third data release, which calls for resistance to governments and corporations:

**## CHINGA LA MIGRA COMMUNIQUE 3 ** 7/01/2011 ** FRATERNAL OWNAGE OF POLICE ***
*******************************************************************************
"For the third knockout blow against Arizona law enforcement, we decided to get destructive. We're defacing eight AZ Fraternal Order of Police websites and releasing a master list of over 1200 officer's usernames, passwords, and email addresses.

Additionally we are leaking hundreds of private FOP documents and several more mail spools belonging to FOP presidents, vice presidents, secretaries, a police chief, and the FOP Labor Council executive directory and webmaster whose insecure web development skills was responsible for this whole mess. We're doing this not only because we are opposed to SB1070 and the racist Arizona police state, but because we want a world free from police, prisons and politicians altogether.

In this batch of emails we found more racist email chain emails, including Springerville's police chief Mike Nuttal forwarding jokes about torturing "ragheads". FOP president Brandon L Musgrave was also forwarding anti-muslim emails while also purchasing large amounts of guns, so we're dumping his paypal and credit card information as well.

Other drama includes internal arguments over FOP positions, disputes over arrested FOP member Michelle Preiss, lots of crude anti-Obama jokes, and lots lots more. Amusingly we also were reading James Mann's emails as they were discussing the AZDPS hacks and struggling to send out press releases explaining why they had a sex offender in their FOP ranks. Initially James changed all his passwords and pulled the AZFOP sites down out of fear of impending hacker attacks, but there is no stopping the kind of chaos we bring upon all those who cross our path.

Truth be told we've been passing around this password list amongst our black comrades for a while now. Much to our amusement we've been reading everybody's emails looking for dirt and personal info, while leaking bits and pieces to expose and instill fear into the crooked cops of Arizona. However the list proved to be too great, and now we are seeking community assistance in going through everybody's inbox to retrieve and expose their secrets. Go forth and bring mayhem to the lives of these corrupt officers, and tell us what you find on irc.anonops.li #antisec.

Let this third and crushing blow against Arizona police send a strong message to the ruling class around the world. You will no longer be able to operate your campaign of terror against immigrants and working people in secrecy: we will find you, expose you, and knock you off the internet. Many lulz have been had while we purposefully strung you along slowly and painfully for the past two weeks. We know exactly what we're doing, so think twice before considering crossing us.

Hackers of the world, join us as we resist against the governments and corporations of the world, for there is enough bounty for everybody aboard the good ship #antisec." 66.

DON CHERRY of hockey night in Canada , was asked on a local live radio talk show, just what he thought about the allegations of torture of suspected terrorists. His reply prompted his ejection from the studio, but to thunderous applause from the audience.
HIS STATEMENT:
"If hooking up one raghead terrorist prisoner's testicles to a car battery to get the truth out of the lying little camel shagger will save just one Canadian life, then I have only three things to say:

Police Officer Lorraine Thompson, former president of the Fraternal Order of Police in Tucson, received a long statement from Arizona State Senator Sylvia Allen, regarding the border and immigration, dated June 6, 2010.Here is an excerpt:
"It will do no good to give them amnesty because thousands will come behind them and we will be over run to the point that there will no longer be the United States of America but a North American Union of open borders. I ask you what form of government will we live under? How long will it be before we will be just like Mexico , Canada or any of the other Central American or South American country? We have already lost our language, everything must be printed in Spanish. We have already lost our history, it is no longer taught in our schools, and we have lost our borders.
The leftist media has distorted what SB 1070 will do. It is not going to set up a Nazi Germany. Are you kidding? The ACLU and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegals from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause, like a traffic stop, to determine if they are here legally. Federal law is very clear, if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you are a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote or get a hunting license. So nothing new has been added to this law. No one is going to be stopped walking down the street. The Socialists who are in power in DC are angry because we dare try and do something. The Socialists wants us to just let them come. They want the 'Transformation' to continue.
Maybe it is too late to save America . Maybe we are not worthy of freedom anymore. But as an elected official I must try to do what I can to protect our Constitutional Republic . Living in America is not a right just because you can walk across the border. Being an American is a responsibility and it comes by respecting and upholding the Constitution, the law of our land, which says what you must do to be a citizen of this country.

FREEDOM IS NOT FREE.
Senator Sylvia Allen."

OK. I did get called by the reporter to verify Leibo's position as a spokesman. The
reporter gave me some of the new names. A few are FOP members. Not all of the
names are DPS, but, most are. There is an AJ officer 'Sabo'on the list. The
reporter said he wasn't going to go into too much depth on the info revealed by the
hackers. Just FYI, I'm going to take down most of the AZ FOP web sites as a

"Then the illegals came by the tens of thousands.

Suddenly our taxes went up to pay for free services; small apartments are
housing 5 families: you have to wait 6 hours to be seen by an emergency room
doctor: your child's 2nd grade class is behind other schools because over
half the class doesn't speak English: Corn Flakes now come in a bilingual
box; I have to press "one" to hear my bank talk to me in English, and people
waving flags other than "Old Glory" are squawking and screaming in the

Maybe it's time for the government to take down the bird feeder.

If you agree, pass this on........."

NCAI urges new means of protecting sacred places

By Brenda Norrell
U.N. OBSERVER & International Report

PHOENIX – The National Congress of American Indians urged the US Congress to create a statute that would protect Native American sacred places from the onslaught of development, intrusion and desecration and to strengthen existing laws to protect Native Americans' freedom of religion, in a resolution passed during its 65th annual convention.
The American Indian Religious Freedom Act was enacted into law 30 years ago in 1978 to protect the religious freedom of Native people. However, the Supreme Court ruled 20 years ago that neither the Act, nor the US Constitution, provided for a course of action to truly protect Native Americans right to worship in their traditional manner. The Supreme Court said Congress would need to enact a statute for that purpose. Congress has not done so.
The American Indian Religious Freedom Act states that "it shall be the policy of the United States to protect and preserve for American Indians their inherent right of freedom to believe, express, and exercise the traditional religions of the American Indian, Eskimo, Aleut, and Native Hawaiians, including but not limited to access to sites, use and possession of sacred objects, and the freedom to worship through ceremonials and traditional rites."
Native Americans say, however, there is no current mechanism to ensure protection of sacred places or religious rights in court. Further, they say there is too little prosecution of violators of sacred places, burial places and cultural items.
Recently, the Religious Freedom Restoration Act failed to protect two sacred places in court, San Francisco Peaks and Snoqualmie Falls. In the case of San Francisco Peaks, the Ninth Circuit Court of Appeals reversed its earlier decision and ruled that sewage water could be used for snowmaking on the mountain sacred to 13 American Indian Nations. On this sacred mountain, one of Four Sacred Mountains to the Navajo or Dine’, medicine people hold ceremonies and gather healing plants. Hualapai and Hopi spiritual leaders were among those speaking out against the desecration.
Klee Benally, Navajo, with the Save the Peaks Coalition in Arizona said, "The struggle to protect Sacred Places from corporate interests is a critical struggle for a livable planet and our cultural survival as Indigenous Peoples. There are hundreds of threatened Sacred Places located on lands held by Federal Agencies such as the US Forest Service and the Bureau of Land Management. We have no guarantees that these agencies will not allow desecration of Sacred Places because there are no laws that ensure their protection."
Benally saying there is an increasing hostility in the courts.
"Congressional action to protect Sacred Places is necessary because we have no religious freedom when it comes to Federal land management decisions. We keep ending up in courts that are historically hostile towards Indigenous Peoples rights. We have very little options, this is why we must also have a broad-based grassroots movement to take action and address this cultural and environmental crisis," Benally said.
NCAI said, “It is time for Congress to enact a right of action for tribes to defend sacred places. Unless tribes can sustain lawsuits, they will not have a seat at federal negotiation tables and agencies and developers will continue to disregard existing consultation requirements. Meaningful consultation and respectful negotiations can obviate the need for litigation. However, if negotiated accords cannot be reached, tribes must be able to protect their holy places in court.”
The NCAI resolution also pointed out that universities are violating Native American graves, in development and museum content.
The NCAI resolution said, “Burial places are also sacred places. At present, there are entities subverting existing laws designed to protect our burial places and our ancestors. These entities include, for example, prominent universities in the University of California system and other federal and federally-assisted educational institutions, museums and agencies.”
Although the resolution does not name the exact institutions, the resolution follows the action of the University of California-Berkeley which recently desecrated an Ohlone burial ground for development, destroying oaks that were hundreds of years old. UC-Berkeley has also been protested for callously storing thousands of Native American remains in a rodent-filled basement. The Smithsonian Institute is among the museums that have long housed thousands of human remains of Indian people, including Native American skulls collected by bounty hunters in racist studies of intelligence.
NCAI’s resolution fails to point out the recent violation of graves and US federal laws in construction of the US/Mexico border wall. On the western portion of Tohono O’odham land in Arizona, the graves of the ancestors of the Tohono O’odham were dug up by Homeland Security’s contractor Boeing, in secret. The remains were removed from O’odham land, before being returned and reburied. Homeland Security Secretary Michael Chertoff waived all federal laws to construct the border wall.
Across the United States, Native Americans, including the Paiutes struggling to rebury “Spirit Cave Man,” in Nevada, are engaged in lengthy court battles. The desecration at the University of California-Berkeley, the plight of Spirit Cave Man and the threat to sacred San Francisco Peaks were among hundreds of issues brought to the Longest Walk, as Native Americans walked across America in 2008, from Alcatraz to DC, for the protection of sacred places and Mother Earth.
As liquor bars and helicopter rides threaten sacred Bear Butte, Yankton Sioux are faced with a large scale hog farm in the middle of their community in South Dakota. A new wave of profiteering uranium mining threatens Lakotas and Navajos. With power plants, coal mining and oil and gas drilling increasing, and the Arctic ice melting, Native Americans walked across America for five months to signal the nation and the world of the danger, while offering prayers for protection.
While burial places are desecrated across the nation, Native Americans ask, “How would you like it if your grandmother was in a museum? How would you like it if your grandfather’s grave was dug up and robbed?”
On the national level, NCAI said that Native Americans must be involved in the federal consultation processes and serve on boards that govern land use.
Further, NCAI said the Native American Graves Protection Repatriation Act must be strengthened in several ways. First, NAGPRA’s definition of Native American needs to be clarified and state that “Native American” means “of, or relating to, a tribe, people, or culture that is or was indigenous to any geographic area that is now located within the boundaries of the United States.”
NAGPRA needs increased penalties for violations of burials and burial grounds, human remains and cultural items. NAGPRA needs to be specifically strengthened with tools for improved law enforcement and prosecutions, NCAI said in the resolution.
In related resolutions, NCAI passed resolutions supporting a moratorium on exploration and oil and gas drilling in the Galisteo Basin of New Mexico; supporting protection of the Zuni Salt Lake in New Mexico and supporting the United Nations Declaration on the Rights of Indigenous Peoples.
The Declaration on the Rights of Indigenous Peoples was adopted Sept. 13, 2007, by the General Assembly of the United Nations.
In its resolution of support, NCAI said, "the declaration by the United Nations supports and reinforces the respect and protection of full self-determination rights by and on behalf of US Tribal Nations as well as the protection of tribal lands and treaties as a matter of international law and policy and is therefore in the vital interests of all US Tribal Nations."
