Morton County Sheriff rejects public information requests on Standing Rock

Morton County Sheriff rejects Freedom of Information Act requests for video, arrest reports, eviction of Oceti Sakowin, and police body cam footage, says Muck Rock

Morton County is one of five law enforcement agencies in the United States concealing public records related to protests, reports Muck Rock. In fact Morton County Sheriff Kyle Kirchmeier is now one of the five worst in the United States when it comes to rejecting Freedom of Information Act requests.

Curtis Waltman of Muck Rock said he sent four protest related FOIA requests to Morton County for video footage, arrest reports, documents relating to the massive emergency management compacts, and reports on the eviction of the Oceti Sakowin camp. The requests rejected include the police officers’ body camera footage.

“All of these have been rejected, with not a single responsive document being handed over. And much of what I asked for not only absolutely exists, it is basic information which should be public knowledge,” Waltman said.

Morton County is refusing to respond to Freedom of Information requests. The other four agencies that are refusing to provide public information are Virginia State Police, Boston Regional Intelligence Center, Chicago Police Department and Austin Police Department.

“Reports coming out of Standing Rock were shocking to many Americans and carried revelations about how law enforcement were conducting themselves in regards to protests. It is a miscarriage of justice and FOIA law to keep these records sealed when there is such a huge amount of public concern.”

Standing Rock Sioux Tribe Bulldozed School at Sacred Stone Camp

Sacred Stone Camp School Bulldozed by Tribe, Following Eviction and Arrest of Water Protectors by Militarized Police

CANNON BALL, North Dakota -- The Standing Rock Sioux Tribe bulldozed the school at Sacred Stone Camp, the children's school built by volunteers from earth and straw. This comes after the tribe evicted and arrested or displaced, all water protectors at Oceti Sakowin Camp, Seventh Generation Camp and Sacred Stone Camp.

LaDonna Allard, Standing Rock Lakota land owner of the site of Sacred Stone Camp, the original camp, said the children's school was bulldozed on Wednesday.

LaDonna said this morning, "Hihanna waste I started out the day being a little down, wanting to cry, because they bulldozed down our beautiful school yesterday. I have not heard about our kitchen but I am sure it is coming down, the many prayers and songs that were shared there, I feel the loss of the fellowship we had in those places."

"These were not professional protesters, most were community members, Native people from across the Americas, many reservations, Native people from urban areas, many people came for a weekend and stayed for months, giving up their jobs and in some cases their homes, people who felt that the time is now to change the world, all ages, all religions, people who took leave from their jobs and families to protect the water, young people who came to help and stayed. We had spiritual leaders from all religions come to pray with us, and people came with water from the world to offer it to the river."

"People felt that healing that is coming from the land, the healing that comes from prayer and community. People learned to live with each other in the camps, we learned the best of humanity in the camps," LaDonna said.

"We also learned the worse in humanity by Morton County, North Dakota Governors, State Officials, tribal Official, BIA police, National Guard, National Parks and Black Swan, DAPL security."

"The physical attacks on people left lifetime injuries, the trauma of our own people attacking us who were supposed to protect and serve, the nightmares the water protectors are having as the loss in our humanity is seen on their faces. I have seen some great leaders arise out of this movement. The youth are the leaders for the future, we need to protect them," LaDonnna said.

Praising the Water Protectors for their sacrifices, courage, and service, LaDonna said, "I will stand on truth, and I will stand for the future of my grandchildren. Mni Wiconi Water is Life."

Standing Rock Tribe Evicted Water Protectors and is Now Bulldozing Camps
The Standing Rock Sioux Tribe passed a resolution in January evicting all water protectors from the camps, which have been home to as many as 10,000 water protectors.

The tribe's resolution instructed the BIA to deliver the trespass notices to the camps. The tribe instructed all law enforcement agencies to carry out the evictions.

The Oceti Sakowin Camp, Seventh Generation Camp, and Sacred Stone Camp were attacked by police. Federal police assaulted water protectors in the same brutal, out-of-control show of excessive force that has been directed by Morton Country Sheriff Kyle Kirchmeier.

All water protectors were arrested or displaced, following the tribe's order. The camps are now being bulldozed and water protectors' property is being destroyed.

Earlier in January, the tribe "reallocated" $3.2 million donated to the water protector camps by supporters, for the tribe's own use.

During 2016, as the frontline resistance grew to the Dakota Access Pipeline -- the crude oil pipeline threatening the Missouri River and water source of millions -- Indian Nations from across North America, and Indigenous from the world, came to the camps, bringing gifts, including truckloads of firewood, food, water and supplies, along with cash donations for the tribe.

At that time, the Standing Rock Sioux Tribe asked for help in fighting the pipeline and welcomed Indigenous from around the world. Standing Rock Chairman Dave Archambault began telling water protectors to go home on Dec. 4, 2016, after announcing one of many public relations announcements by the Army Corps of Engineers and Obama administration, regarding the permit for the pipeline. However, the announcements and delays were short-lived, and construction continued.
Then in February, the tribe brought in militarized, federal police to evict, arrest and displace water protectors. The tribe is now bulldozing the camps and destroying the belongings of water protectors. 

Sacred Stone School Construction Was Labor of Love

The movement of 'Water is Life' awakened people around the world to the message of water.

A Petaluma, California, man described the labor of love that went into building the Sacred Stone Camp school with earth and straw.

"Petaluma native Miguel Elliott said he wasn’t sure exactly what he would uncover as he helped dig through the frozen North Dakota ground last month, advancing gradually through the icy surface to reveal, inch by labored inch, the softer earth beneath."

As the news came today that the tribe had bulldozed the school, water protectors pointed out that these are only material items, and the Spirit can not be demolished by a small group of politicians or bulldozers.

'Stronghearts to the Front,' remains the battle cry in the Dakotas.

Water Protectors Jailed in Dog Kennels, Assigned Numbers as Concentration Camps

MANDAN, North Dakota -- Morton Country Sheriff Kyle Kirchmeier caged Standing Rock water protectors in "dog kennels" and wrote numbers on their arms, as was done in concentration camps.
After being caged in a 'dog kennel' and assigned a number as in the Nazi concentration camps, this water protector, in the video above, describes the heart break of the brutal police attack and arrests of Native American elders on Thursday, Oct. 27, 2016.
"They are good, strong people of our community," she said of the Native elders brutally arrested by police and National Guard. Dakota Access Pipeline is violating all human rights and civil rights as it rushes to complete the last stretch of pipeline construction.
She describes the heartbreak of ceremonial bundles on the ground and elders being arrested with their eagle feathers in their hair.
"No one had guns or anything," she said, describing facing the tear gas, sound cannons, percussion grenades, pepper spray and loaded assault weapons pointed at them.
She describes how the people stood up to the tear gas and the brutality inflicted on them that day, as they defending the sacred places, burial places, and sacred water of the Missouri River.
Then the water protectors, elders and youths, were taken in buses to jail.
"We were caged in dog kennels."
"We sat on the floor."
"We were marked with numbers."
"We were held in the garage."
They put the women in two dog kennels covered with tarps in the garage. They could not see out.
She said she could not wrap her mind around it.
Water protectors had numbers written on their arms, as was done by Nazis in concentration camps.

Morton Country Sheriff and the violent police and National Guard engaged in torture which they placed a hood over a water protector during a lock down to protect the water and burial places. These violent police further engaged in torture by pouring water over handcuffed water protectors in the cold.

CANNONBALL, North Dakota -- Over 300 police officers in riot gear, 8 ATVs, 5 armored vehicles, 2 helicopters, and numerous military-grade humvees showed up north of the newly formed frontline camp just east of Highway 1806.  The 1851 Treaty Camp was set up this past Sunday directly in the path of the pipeline, on land recently purchased by DAPL.  Today this camp, a reclamation of unceded Dakota territory affirmed as part of the Standing Rock Reservation in the Ft. Laramie Treaty of 1851, was violently cleared.  Both blockades established this past weekend to enable that occupation were also cleared.

WAR CRIME: Morton County Engaged in Torture -- Hooded Water Protector

Morton Country Sheriff Kyle Kirchmeier displayed proof that law enforcement is engaged in torture at Standing Rock. The water protector's goal was to halt the construction of the Dakota Access Pipeline which is rapidly approaching the Missouri River, and threatening to poison the river with an underwater crude oil pipeline. 
Morton County engaged in a second act of torture when it forced the daughter of LaDonna Brave Bull Allard to remain naked in a jail cell. Her daughter was arrested for no credible cause, strip-searched and forced to remain naked in a jail cell all night.

The U.S. Army Field Manuals states the use of hoods is use of torture
In late 2006, the military issued updated U.S. Army Field Manuals on intelligence collection (FM 2-22.3. Human Intelligence Collector Operations, September 2006) and counterinsurgency (FM 3-24. Counterinsurgency, December 2006). Both manuals reiterated that "no person in the custody or under the control of DOD, regardless of nationality or physical location, shall be subject to torture or cruel, inhuman, or degrading treatment or punishment, in accordance with and as defined in U.S. law."[11] Specific techniques prohibited in the intelligence collection manual include:
  • Forcing the detainee to be naked, perform sexual acts, or pose in a sexual manner;
  • Hooding, that is, placing hoods or sacks over the head of a detainee; using duct tape over the eyes;
  • Applying beatings, electric shock, burns, or other forms of physical pain;
  • Waterboarding;
  • Using military working dogs;
  • Inducing hypothermia or heat injury;
  • Conducting mock executions;
  • Depriving the detainee of necessary food, water, or medical care.
