A federal appeals court ruled in favor of law enforcement who fired rubber bullets, bean bags and projectiles at Standing Rock water protectors, and blasted them with water hoses in freezing temperatures, at Backwater Bridge on November 20, 2016.

Water protectors suffered critical injuries while seeking to halt the Dakota Access Pipeline in North Dakota. However, the federal appeals court ruled against them in the class action, civil rights lawsuit that revealed excessive force by law enforcement.

Three hundred water protectors were injured on the night of November 20, 2016, at Backwater Bridge at Standing Rock. Twenty-six were seriously injured and taken by ambulance to nearby hospitals. Guy Dull Knife III was one of them. On Tuesday, an excessive force lawsuit filed against Morton County Sheriff Kyle Kirchmeier and others will be argued before the Eighth Circuit Court of Appeals in St. Louis.

"On the night of November 20-21, 2016, law enforcement shot unarmed, nonviolent water protectors with impact munitions, flash-bang explosives, and freezing blasts of water over the course of ten hours, seriously injuring Appellants and many others," states the federal class-action, civil rights lawsuit Dundon v Kirchmeier.

Wašté Win Young, Water Protector and former Tribal Historic Preservation Officer for Standing Rock, reflected on the significance of the case.

“I was born and raised on Standing Rock. It’s my home. The law enforcement that attacked us were our neighbors. It was surreal. Even now, when I cross that bridge I remember the people who got maimed, fell through ice, sprayed with water and chemicals, injured by those who are supposed to protect us. There are several images imprinted in my mind from November 20, 2016."

"I remember law enforcement indiscriminately aiming water canons at a group of Native American individuals who were praying on their knees, while other law enforcement personnel shot tear gas and projectiles into the crowd where I was standing."

"I nearly choked on the tear gas. It is my hope that the rule of law will prevail against the law enforcement who blatantly disregarded the constitutional and civil rights of hundreds of peaceful protestors," Waste Win Young said.

CANNONBALL, North Dakota -- Over 300 police officers in riot gear, 8 ATVs, 5 armored vehicles, 2 helicopters, and numerous military-grade humvees showed up north of the newly formed frontline camp just east of Highway 1806.  The 1851 Treaty Camp was set up this past Sunday directly in the path of the pipeline, on land recently purchased by DAPL.  Today this camp, a reclamation of unceded Dakota territory affirmed as part of the Standing Rock Reservation in the Ft. Laramie Treaty of 1851, was violently cleared.  Both blockades established this past weekend to enable that occupation were also cleared.

CANNON BALL, North Dakota -- Labor Union workers -- nurses, public defenders, pipeline workers, and teachers -- arrived at Standing Rock Camp to support the water protectors and bring a halt to the Dakota Access Pipeline construction.

Marty Goodman, retired transit worker, from Manhattan in New York, said transit workers identify very strongly with the struggle.

"We're fighting pipelines in New York City."

Union workers came from Cheyenne, Wyoming; Casper, Wyoming; Kansas City, Missouri; Madison, Wisconsin; Lafayette, Colorado, and elsewhere came to defend the water.

They said, "Water is Life!"

A registered nurse from Lafayette, Colorado, said the leader for the AFL-CIO Richard Trumka, had spoken out in support of DAPL -- but union workers did not have a voice in Trumka's decision to promote DAPL.

In Colorado, they are fighting fracking and fighting for the water, he said.

"If workers can put that pipe in the ground, then they can take that pipe right back out and put it on the truck and ship it out of there."

A public defender, with Labor for Palestine, and Labor for Standing Rock, spoke on the vicious attack here by police on unarmed peaceful water protectors.

He said what is happening here reminds him of the Civil Rights struggle, Wounded Knee, Palestine, Ferguson and other struggles.

Most of all, he said, it reminds him of Palestine.

We call on the state of North Dakota to oversee the actions of local law enforcement to, first and foremost, ensure everyone’s safety. The Department of Justice must send overseers immediately to ensure the protection of First Amendment rights and the safety of thousands here at Standing Rock. DOJ can no longer ignore our requests. DAPL's Armed Security Charges into Camp with Weapon -- Arrested by BIA

Today at Standing Rock during the 1851 Treaty Camp standoff, a hired DAPL security guard was spotted in the crowd with an automatic rifle in his vehicle. When he was spotted, he began to head towards camp. Water protectors made an effort to stop him on the road, in which he shot off onto the shoulder, and began speeding towards camp through the grass. The community feared for the women and childraen and began taking action. Water protectors began setting up a blockade at the bridge ahead, as 2 water protectors used their vehicles to crash into the securities truck, causing him to spin out on the riverbank. The security then exited his vehicle, cocked his AR-15, and began back stepping from protectors into the nearby river. A near half our stand off took place where water protectors pleaded and tried to defuse the situation of the man coming directly at their families. Eventually, BIA came to the scene, disarmed the man, and his was placed under arrest.

America, this is what is happening here. DAPL will do anything possible, include the threat of death and violence to get this pipeline through. DO NOT LET MAINSTREAM MEDIA LIE TO YOU. Protectors are facing the threat of death simply for protecting water and preserving history.

Morton County Sheriff's Department retracted their statement of the DAPL security rushing towards Standing Rock camp with the AR-15 "being treated for a gunshot wound to his hand" after photo evidence proved they were in fact a BUNCH OF LIARS.

The man is now in FBI custody after being turned over by BIA.

Cheyenne River Chairman receives little response from Obama in Los Angeles

Obama fails to respond, as front line warriors rush to face a convoy of police

LOS ANGELES -- Cheyenne River Sioux Chairman Harold Frazier said he did not get the response he hoped for during a meeting with President Obama today.

"I didn't really get the answers that I was hoping for, but I'm still optimistic we will prevail in stopping this pipeline," Chairman says in the video below.

Chairman Frazier said Obama agreed to continue working through the proper channels and agencies in the federal government.

Chairman Frazier urged everyone to stay strong. "We have to stay strong and keep up the fight."

"In the end, we will prevail."

"In the end, we will stop this pipeline."

Let's keep working," Chairman Frazier said.

In other news tonight, Hollywood actor Mark Ruffalo spoke with Standing Rock water protectors.

During the gathering at the casino hotel, the water protectors received a message that a large convoy of police were enroute tonight.

The front line warriors, with the magnitude of Crazy Horse, in the Spirit of Crazy Horse, rushed from the talk room before Ruffalo spoke.

Mark Ruffalo spoke on how the forces want to divide people.

"The Black Snake is here."

Ruffalo spoke on the depth of suffering that the Native people have, and how it is what the world needs right now.

Ruffalo said he is humbled and honored to be here. He thanked the people for what they are teaching him and said he will be with the water protectors tomorrow, Wednesday.

DAPL is pressing to drill where the new Sacred Ground Camp is located on the path of the pipeline. Law enforcement special operations from Minnesota, Indiana and other states were seen enroute to Standing Rock.

WAR CRIME: Morton County Engaged in Torture -- Hooded Water Protector

Morton Country Sheriff Kyle Kirchmeier displayed proof that law enforcement is engaged in torture at Standing Rock. This photo posted by the Sheriff's Department is at the site of a lockdown on Saturday, Oct. 22, 2016, by a Standing Rock water protector. The water protector's goal was to halt the construction of the Dakota Access Pipeline which is rapidly approaching the Missouri River, and threatening to poison the river with an underwater crude oil pipeline. 

Morton County engaged in a second act of torture when it forced the daughter of LaDonna Brave Bull Allard to remain naked in a jail cell. Her daughter was arrested for no credible cause, strip-searched and forced to remain naked in a jail cell all night.

The U.S. Army Field Manuals states the use of hoods is use of torture

In late 2006, the military issued updated U.S. Army Field Manuals on intelligence collection (FM 2-22.3. Human Intelligence Collector Operations, September 2006) and counterinsurgency (FM 3-24. Counterinsurgency, December 2006). Both manuals reiterated that "no person in the custody or under the control of DOD, regardless of nationality or physical location, shall be subject to torture or cruel, inhuman, or degrading treatment or punishment, in accordance with and as defined in U.S. law."^[11] Specific techniques prohibited in the intelligence collection manual include:

• Forcing the detainee to be naked, perform sexual acts, or pose in a sexual manner;
• Hooding, that is, placing hoods or sacks over the head of a detainee; using duct tape over the eyes;
• Applying beatings, electric shock, burns, or other forms of physical pain;
• Waterboarding;
• Using military working dogs;
• Inducing hypothermia or heat injury;
• Conducting mock executions;
• Depriving the detainee of necessary food, water, or medical care.

ST. ANTHONY, North Dakota -- Twenty-seven water protectors were arrested today, including two charged with felonies who were locked down to Dakota Access Pipeline machinery.

Actress Shailene Woodley was arrested by riot police, as police continue to target livestreamers and members of the media. 

Activist Vic Camp was also just arrested. Twenty-five water protectors were arrested by riot police, and two others were arrested and charged with felonies who locked down to Dakota Access Pipeline construction machinery.

Shailene had just finished livestreaming, as riot police arrived with armored vehicles in riot gear.

Water protectors seated in a tipi were arrested and slammed to the ground by police.

Water protectors said at 11 a.m. today that they woke at sunrise for prayer. Water protectors then raveled by way of caravan to a pipeline construction site and erected tipi poles.

Two miles away, allies were locked down to machinery since 5:30 a.m. 

Police began targeting the media and livestreamers with criminal trespass charges that were dated Sept. 3. On this day, bulldozers tore across ancestral burial places and water protectors were attacked with vicious dogs and pepper spray.

Democracy Now! producer Amy Goodman is charged with criminal trespass for her coverage. Cody Hall, media spokesman for Red Warrior Camp, spent four days in jail on criminal trespass charges. Unicorn Riot was arrested and jailed while livestreaming.

ST.ANTHONY, Dakota du Nord – Vingt-sept personnes ont été arrêtées ce lundi 10 octobre, dont deux ont été mises en accusation pour s’être enchaînées à des machines de Dakota Access Pipeline.
L’actrice Shailene Woodley a été arrêtée par la police anti-émeute, étant donné que la police continue à s’en prendre à ceux qui filment ou envoient des nouvelles en direct et aux représentants des médias.
L’activiste Vic Camp vient aussi d’être arrêté. Vingt-cinq protecteurs de l’eau ont été également arrêtés par la police anti-émeute, et deux autres ont été inculpés pour s’être enchaînés à des machines de construction.
Shailene venait juste de finir de filmer à l’arrivée de la police dans des blindés et en tenue de combat.

Des protecteurs de l’eau dirent à 11h ce matin qu’ils s’étaient levés à l’aube pour prier. Puis ils sont partis en caravane vers un site de construction du pipeline et ont érigé des poteaux pour monter un tipi.
3,6 km plus loin, des alliés s’enchaînaient à des machines depuis 5h30 du matin.
La police a commencé par s’en prendre aux médias et aux gens qui filmaient en direct sur la base d’accusations d’effractions datant du 3 septembre. Ce jour-là, des bulldozers avaient éventré des sites funéraires ancestraux et les protecteurs de l’eau avaient été attaqués avec des chiens méchants et arrosés de poivre.
La productrice de Democracy Now!, Amy Goodman, est toujours poursuivie pour ‘effraction’ à cause de son reportage. Cody Hall, le porte-parole du Red Warrior Camp pour les médias, a passé quatre jours en prison et est également accusé d’effraction. Le caméraman de Unicorn Riot a été arrêté et emprisonné alors qu’il était en train de filmer.
